Default AT&T is pathetic!

Had the phone for 42 days. Phone started locking up on any app I ran: text messages, editing contacts, blank start menu. The phone is totally messed up. Can't even change the volume of a ringtone without it freezing up. And when it does freeze up, sometimes the 4-color wheel just spins until I take out the battery, sometimes the Q will lock up, sometimes it restarts on it's own. No pattern to this at all. The real problem is with AT&T. When I requested a NEW replacement, not a refurbished replacement, they said that is impossible. I told them I haven't even paid my 1st new plan yet. She said, it's past 30 days and I'll have to accept the refurbished one. I told her, I'm not paying $449 to own a refurbished phone. Then I said, I'm leaving AT&T if they didn't work with me and they basically said...."Good bye". They are forcing the early penalty fee for breaking the 2-year contract. I responded with, the contract was null and void when you sold me a defective device to begin with. I hate to ask if anyone has had any success with receiving a NEW phone for a defective one, if it was not exactly inside the 30-day period.....but, have you?

have you tried doing a master reset? Or perhaps talking with a store rep in person?

Yes, tried Master Reset: No changes. Now, I can't get to any more of those options because I can't access the start menu items. Went into the store where I purchased from and they picked up the phone and called AT&T customer service which is where it went from there. I was hoping my local store would take care of me, but the manager just said, "Sorry, if it's past the 30 days, we have to call the 'Support Center'. I was really wanting this phone, as I've been waiting forever for this.

do you have insurance?

another way to do a master reset is turn phone off, then hold down the chrome button while you turn phone back on and follow prompts

Insurance was not an available option for this phone, otherwise I would have purchased it. I've tried the master reset and it is not solving the issue. Looks like my only option is to spend $400 to get a new one (after my 1st one lasted 42 days), or exchange it and own a refurbished phone at a new phone price.

sometime the refurbs are better than the new ones. Insurance should be an option on any phone

also check to see about a manufacturer's warranty. I know there is one, just not sure about the timeframe it covers

Didn't you post this on HoFo as well? If you don't want a referbished phone from AT&T, then send it back to Motorola for repair. No need to pay another $400 (as you mentioned above) for another phone. Have you tried calling Motorola and speaking with them - and describing to a tech on what is occuring. Have you tried any remedies? It appears from your other posts you paid full price for the phone - didn't you get a $150 rebate?

life goes on.........so whats the problem with a refurb? i had a brand new q like you and i had some problems and they sent me a refurb, and it works better than my brand new one. if the refurb phone looks cosmetically brand new, then whats the big deal?

I think for him its the point of getting used for a new price. With no insurance..talk to Motorola.

Just because it comes in a new box doesnt always mean the phone is :-)
