Yes, I realize that would normally be the case for any phone. However, in this case the argument would be that the phone is defective and since I have paid for the insurance, I am entitled to have the problem fixed. Since giving me a new Q won't fix the problem, allowing me to pay the difference for the upgrade seems reasonable. Its worth a try.
